In these Terms, Atom Airsoft Oy is referred to as the “Service Provider”, “we”, “us” or “our”.
1.3 In these Terms, “Customer”, “User”, “you” or “your” refers to the person using the Service or purchasing products through the Service. A “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession. A “Business Customer” means a legal person or a natural person acting primarily for business or professional purposes.
1.4 By using the Service, creating a customer account, or placing an order, you confirm that you have read and accepted these Terms and agree to be bound by them.
2. Right of Use
2.1 Private Consumers
The Service is primarily intended for private individuals who are at least 18 years of age. Certain products, such as airsoft guns and other age-restricted items, may be subject to legal age restrictions, guardian consent requirements, or our own age-verification policy. We reserve the right to request proof of age and to cancel orders that do not meet legal requirements or our age-verification policy.
2.2 Business Customers
Business Customers may also use the Service. Unless expressly stated otherwise, these Terms apply to Business Customers as well, except that the mandatory rights provided in the Finnish Consumer Protection Act and EU consumer legislation do not apply to Business Customers.
2.3 Intellectual Property Rights
All intellectual property rights to the content of the Service, including but not limited to text, images, product descriptions, logos, trademarks, graphics and software, belong to the Service Provider or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service for browsing and placing orders for your own use. Any reproduction, distribution or other use of the content beyond what is necessary for normal use of the Service is prohibited without our prior written consent.
3. Registration
3.1 Account Creation
You may register as a user of the Service by filling in the registration form and choosing a username and password (a “Customer Account”). You may also place orders as a guest without creating an account.
3.2 Accuracy of Information
You must provide accurate, complete and up-to-date information when registering and when placing orders. You are responsible for updating your information as necessary.
3.3 Acceptance of Terms
By placing an order or creating a Customer Account, you confirm that you have read, understood and accepted these Terms and our Privacy Policy, and that you agree to comply with them.
3.4 Registration is free of charge. We reserve the right to refuse, suspend or terminate a Customer Account if we reasonably suspect misuse, fraudulent activity or other violation of these Terms.
4. User Responsibilities and Obligations
4.1 You are responsible for all actions taken and all orders placed using your Customer Account, including your username and password.
4.2 You must keep your login credentials confidential and secure. If you suspect that your login credentials have been compromised or accessed by an unauthorized person, you must change your password and notify us without undue delay.
4.3 You agree to use the Service in compliance with applicable laws and good practice, and not to:
- provide false information,
- interfere with or disrupt the operation of the Service,
- attempt to gain unauthorized access to our systems or other users’ accounts, or
- use the Service for unlawful purposes, including but not limited to fraudulent purchases.
5. Collection and Use of Personal Data
5.1 Data Controller
The Service Provider, Atom Airsoft Oy, is the controller of the personal data processed in connection with the Service and customer relationships.
5.2 Processed Personal Data
We collect and process personal data necessary for processing orders and providing the Service, which may include:
- first name and last name,
- postal address, postcode and city,
- country of residence,
- email address,
- phone number,
- order history and payment information through our payment service providers, and
- Customer Account information, if you register.
5.3 Purposes and Legal Bases
We process personal data for the following main purposes:
- processing and delivering orders and handling returns,
- managing customer relationships and Customer Accounts,
- fulfilling legal obligations, such as bookkeeping and consumer protection obligations,
- preventing and investigating misuse and fraud,
- sending service messages relating to orders and the Customer Account, and
- sending direct marketing messages, such as newsletters, where you have given consent or where permitted by law.
The processing bases are primarily performance of a contract, compliance with legal obligations, our legitimate interests and your consent, especially for electronic direct marketing where required by law.
5.4 Disclosure of Personal Data
We do not sell personal data. We may disclose personal data to:
- payment service providers and financial institutions,
- logistics and delivery partners,
- IT and hosting service providers, and
- other service providers who process personal data on our behalf and according to our instructions.
In some cases, personal data may be transferred outside the EU/EEA. In such cases we will ensure that adequate safeguards are in place, for example standard contractual clauses, in accordance with applicable data protection law.
5.5 Direct Marketing and Newsletter
Personal data provided for the Atom Airsoft online store customer register is processed in accordance with our Privacy Policy. By subscribing to our newsletter or otherwise giving your consent to electronic direct marketing, you agree to receive regular messages from Atom Airsoft, such as newsletters, product news, offers and event information. You may withdraw your consent at any time by:
- clicking “Unsubscribe” in an email or SMS message you receive from us, or
- contacting us by email at info@atom-airsoft.fi and requesting removal from the mailing list.
Unsubscribing from direct marketing does not affect your receipt of order confirmations or other service messages necessary to fulfil your orders or maintain your Customer Account.
5.6 Data Subject Rights
You have the right, subject to applicable law, to:
- access your personal data,
- request the rectification or erasure of your data,
- restrict or object to processing,
- withdraw your consent to direct marketing at any time, and
- lodge a complaint with the competent data protection authority, which in Finland is the Office of the Data Protection Ombudsman.
More detailed information on the processing of personal data is provided in our Privacy Policy, which forms an integral part of these Terms.
6. Ordering
6.1 Order Process and Contract Formation
You may place orders through the Service by following the instructions on the website. Before submitting an order, you will be shown the total price, including applicable taxes and delivery costs.
A binding sales contract between the Consumer and the Service Provider is formed when:
- you have placed your order through the Service, and
- the Service Provider has sent you an order confirmation by email, confirming the availability, price and delivery of the product(s).
6.2 Right to Reject or Cancel Orders
We reserve the right to decline or cancel an order in justified situations, including but not limited to:
- the product is out of stock or unavailable,
- incorrect pricing or typographical errors that are clearly recognizable as such,
- suspicion of misuse, fraud or identity theft,
- failure to meet age, import, customs, delivery, product-specific or other legal requirements in Finland or in the destination country, or
- carrier, customs, safety or technical limitations that prevent us from delivering the product.
If we cancel an order after payment has been made, we will refund all payments we have received from you for that order without undue delay and, in any event, within the time required by applicable law.
6.3 Age-Restricted Products
For certain products, such as airsoft guns and other age-restricted or otherwise regulated items, we may verify your age upon delivery or collection and may also require additional information where necessary to comply with legal, customs, carrier or destination-country requirements. If you cannot prove that you meet the legal age requirement or our age-verification policy, we may refuse delivery or handover of such products and cancel the order. In such a case, we may deduct any reasonable costs, such as shipping and return costs, from the refund to the extent permitted by law.
6.4 Language of the Contract
These Terms are available in English and may also be provided in Finnish. In the event of discrepancies between language versions, the Finnish version of the Terms shall prevail, unless otherwise required by mandatory law.
6.5 Country-specific Restrictions, Airsoft Guns and Power Limits
Airsoft guns, replicas, magazines, gas products, batteries, accessories and other airsoft-related products may be subject to country-specific laws, import restrictions, customs requirements, age restrictions, marking requirements, transport rules, power limits or other local requirements in the destination country.
When ordering products for delivery outside Finland, you are responsible for ensuring that the product may be lawfully imported, purchased, possessed and used in the destination country. This includes, where applicable, checking local rules concerning airsoft gun muzzle energy, muzzle velocity, appearance, required markings, age limits, permits, customs clearance and safe transport.
Product power information, such as muzzle velocity, FPS or joule values, is provided for general product information only and may be based on manufacturer data, our own testing or typical performance with a specified BB weight. Actual performance may vary depending on the individual product, BB weight, gas, battery, temperature, hop-up setting, wear, maintenance and other conditions.
We do not guarantee that a product is legal for import, possession or use in every destination country, or that it complies with the power limits or rules of any specific airsoft game site, event or local authority outside Finland. Game sites and event organisers may also apply their own power limits and safety rules, which may be stricter than applicable law.
If a product is refused, delayed, held, seized, confiscated, destroyed or otherwise not delivered by customs, authorities or a carrier due to destination-country laws, import restrictions, customs requirements, missing permits, the customer’s failure to complete customs clearance, or other circumstances outside our control, the customer is responsible for any resulting consequences, costs, fees, taxes, storage charges, return shipping costs or loss of the product.
If such a shipment is returned to us in resalable condition, we may refund the product price or handle the matter as a return, after deducting any reasonable costs incurred by us, such as shipping, return shipping, handling, customs or carrier fees, to the extent permitted by applicable law.
If the product is seized, confiscated, destroyed or otherwise not returned to us, we are not obliged to refund the product price or shipping costs, unless otherwise required by mandatory consumer protection law. This does not affect your statutory rights in cases where the product is defective, incorrect or not in conformity with the contract for reasons attributable to us.
We reserve the right to request additional information, refuse delivery, cancel an order or remove products from an order if we reasonably believe that the product cannot be lawfully or safely delivered to the destination country, or if the order does not meet legal, carrier, customs or age-verification requirements. If an order is cancelled by us after payment has been made, we will refund the payments received for the cancelled products without undue delay and in accordance with applicable law.
Nothing in this section limits your mandatory statutory rights as a Consumer.
7. Product Prices and Payment
7.1 Product Prices
The product price is the price displayed on the product page of the Service at the time of ordering. All prices are shown in euros (EUR), unless otherwise stated.
7.2 Value-Added Tax (VAT)
For deliveries within Finland, prices include Finnish value-added tax (VAT). For deliveries within the European Union, the applicable VAT rate is determined according to EU VAT rules and, where applicable, the One Stop Shop (OSS) scheme. For deliveries outside the European Union or to the Åland Islands, orders are generally exempt from Finnish VAT. You are responsible for any local taxes, customs duties or other charges that may be imposed in the destination country.
7.3 Delivery Costs
Delivery costs are added to the product price, unless the order exceeds the minimum amount required for free shipping as displayed in the Service. Delivery costs are specified in the Service before the order is confirmed and may depend on the delivery method and destination.
7.4 Payment Methods
Available payment methods are displayed in the Service before you place your order. Payments are processed via secure third-party payment service providers. By using a particular payment method, you accept the terms and conditions of the respective payment service provider.
7.5 Price Errors
If a product has been listed at an obviously incorrect price, for example due to a technical error or typographical mistake, we are not obliged to sell the product at that incorrect price if the error was or should reasonably have been obvious to you. In such cases, we will contact you and offer the product at the correct price or cancel the order and refund any payments received.
8. Delivery
8.1 Delivery Methods and Transport Agreement
The Service Provider delivers products to the Customer using third-party carriers. The available delivery methods and estimated delivery times are shown in the Service at the time of ordering.
8.2 Shipping Costs
Shipping costs are added to the total price of the order and are shown in the Shopping Cart and at checkout before you confirm your order.
8.3 Delivery Time
Delivery times vary depending on product availability, chosen delivery method and destination. Any delivery times presented in the Service are estimates. We will dispatch products as soon as reasonably possible and within the time required by applicable consumer protection law.
8.4 Partial Deliveries
The Service Provider reserves the right to deliver the ordered products in separate shipments, at no extra cost to you, if this is necessary for timely delivery.
8.5 Risk of Loss and Damage in Transit
The Service Provider is responsible for the loss or damage of products during transport to the Customer. The risk passes to the Consumer when the product has been delivered to the Consumer or a person designated by the Consumer and who is not the carrier. This does not affect section 6.5 concerning customs, import restrictions, seizure, confiscation or destruction due to destination-country requirements or circumstances outside our control.
8.6 Force Majeure and Delays
We are not liable for delays or failure to perform our obligations to the extent that such delay or failure is caused by an event of force majeure as defined in section 13. This limitation does not affect your statutory rights as a Consumer.
8.7 Restricted Products and Carrier Limitations
Certain products, such as gas products, batteries, pressurised containers, airsoft guns or other restricted items, may be subject to carrier-specific or country-specific shipping limitations. Available delivery methods may therefore vary depending on the product type and destination.
We reserve the right to change the delivery method, refuse delivery or cancel the affected part of the order if the selected delivery method cannot be used for legal, safety, carrier or customs reasons. If an order or part of an order is cancelled by us after payment has been made, we will refund the affected payment without undue delay and in accordance with applicable law.
9. Right of Withdrawal, Cancellation and Returns
This section applies primarily to Consumers located in the EU/EEA. Business Customers do not have a statutory right of withdrawal under the Finnish Consumer Protection Act.
9.1 Statutory Right of Withdrawal (Distance Selling)
If you are a Consumer residing in the EU or EEA and you purchase products through the Service as a distance contract, you have a statutory right to withdraw from the contract within 14 days without giving any reason.
9.2 Start of the Withdrawal Period
The 14-day withdrawal period begins:
- on the day you or a third party other than the carrier and indicated by you acquires physical possession of the product,
- in the case of multiple products ordered in one order and delivered separately, on the day on which you acquire physical possession of the last product, or
- in the case of delivery of a product consisting of multiple lots or pieces, on the day on which you acquire physical possession of the last lot or piece.
9.3 Exercising the Right of Withdrawal
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by an unambiguous statement within the 14-day withdrawal period. You may, for example:
- send an email to info@atom-airsoft.fi stating your order number, your name, address and that you are exercising your right of withdrawal, or
- use any withdrawal or return form we make available in the Service.
Simply failing to collect the shipment or returning the product without a clear withdrawal notice is not sufficient to exercise the statutory right of withdrawal.
9.4 Effects of Withdrawal and Refunds
If you withdraw from the contract:
- we will refund all payments received from you, including the cost of the most economical standard delivery option offered by us, if delivery costs were paid by you, and
- we may deduct from the refund any reduction in the value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
We will make the refund without undue delay and in any event no later than 14 days from the day on which we were informed of your decision to withdraw. We may delay the refund until:
- we have received the returned products, or
- you have supplied evidence of having sent back the products,
whichever is earlier.
We will make the refund using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the refund.
9.5 Condition and Handling of Returned Products
You may handle and inspect the products to the extent necessary to determine their nature, characteristics and functioning in the same way you would be allowed to do in a physical store. You are liable for any diminished value of the products resulting from handling other than what is necessary for this purpose.
We recommend that you return the product in its original packaging with all accessories, manuals and other items included in the delivery. However, the exercise of the statutory right of withdrawal is not conditional on the product being unused or returned in the original packaging, provided that the product is otherwise properly packaged for transport and protected against damage.
9.6 Return Deadline
If you exercise your right of withdrawal, you must send back or deliver the products to us without undue delay and in any event no later than 14 days from the day on which you notified us of your withdrawal. The deadline is met if you send back the products before the period of 14 days has expired.
9.7 Return Shipping Costs, Customs Issues and International Returns
(a) Returns from Finland
For Consumer orders delivered within Finland, we offer free returns via Matkahuolto when you use the return methods described in our Return Instructions. Depending on the return method, the return may be created using our Matkahuolto contract ID, through the Matkahuolto Paketit app, or without logging in by using the original shipment ID, provided that creating a return is available for that shipment in Matkahuolto’s system.
When you use the return method provided by us and follow our Return Instructions, we bear the direct costs of the return shipping within Finland.
More detailed return instructions are available in our Refund Policy: https://atom-airsoft.fi/en-fi/policies/refund-policy
(b) Returns from Other Countries
For Consumer orders delivered outside Finland, you are responsible for the direct costs of returning the products when exercising your statutory right of withdrawal, unless we have expressly agreed otherwise or unless the product is defective, damaged in transit or incorrect. You should choose a reliable shipping method with tracking and sufficient insurance, as you bear the risk until the products have been received by us.
If a shipment delivered outside Finland is refused, delayed, held, seized, confiscated, destroyed or otherwise not returned to us due to destination-country laws, import restrictions, customs requirements, missing permits, unpaid customs duties or taxes, the customer’s failure to complete customs clearance, or other circumstances outside our control, we are not obliged to refund the product price or shipping costs unless otherwise required by mandatory consumer protection law.
If such a shipment is returned to us, we may deduct reasonable costs incurred by us before refunding the remaining amount, such as original shipping costs, return shipping costs, handling costs, customs fees, carrier fees or other direct costs, to the extent permitted by applicable law.
9.8 Defective, Damaged or Incorrect Products
If the product is defective, damaged in transit or you have received an incorrect product:
- please contact us without undue delay at info@atom-airsoft.fi, and
- we will provide instructions on how to return the product.
In case of defective, damaged or incorrect products, we will:
- bear the return shipping costs when the return procedure instructed by us is followed, and
- repair, replace or refund the product in accordance with applicable consumer protection law.
Your statutory rights regarding defective products, such as repair, replacement, price reduction or refund, remain unaffected.
9.9 Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply to certain types of contracts as specified in applicable consumer legislation. This may include, for example:
- products made to the consumer’s specifications or clearly personalized,
- products that are liable to deteriorate or expire rapidly,
- sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery,
- sealed audio or video recordings or sealed computer software which were unsealed after delivery, and
- digital content not supplied on a tangible medium, where performance has begun with the consumer’s prior express consent and acknowledgement of the loss of the right of withdrawal.
Where such exceptions apply, they will be indicated in the product description or during the order process.
9.10 Uncollected Shipments
Failing to collect a shipment from a pick-up point or carrier without submitting a withdrawal notice is not in itself considered an exercise of the right of withdrawal. In such cases, we may charge you reasonable costs incurred from the return of the uncollected shipment, such as shipping, return shipping and handling costs, to the extent permitted by applicable law.
9.11 Business Customers
The statutory right of withdrawal under consumer protection legislation does not apply to Business Customers. Returns by Business Customers are handled on a case-by-case basis in accordance with separate agreement or our then-current business return policy.
10. Amendments to the Service and These Terms
10.1 We may develop and modify the Service from time to time, for example by adding or removing features, changing the layout, or updating product information.
10.2 We may amend these Terms from time to time. The updated Terms will be published in the Service with an indication of the date of the latest update.
10.3 Unless otherwise required by mandatory law, amendments to the Terms apply only to orders placed after the amended Terms have entered into force. Orders placed before the amendment remain subject to the Terms in force at the time of the order.
10.4 If you maintain a Customer Account, we may notify you of material changes to the Terms by email or by a notice in the Service within a reasonable time before the changes take effect, where required by law.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms and any distance sales contracts concluded through the Service are governed by Finnish law, excluding its conflict-of-law provisions. If you are a Consumer residing in another EU/EEA member state, the mandatory consumer protection provisions of your country of residence may also apply and cannot be derogated from by agreement.
11.2 Negotiation and Complaints
If you have a complaint or dispute concerning your order or the Service, you should first contact our customer service:
- Email: info@atom-airsoft.fi
- Phone: +358 44 236 0413
We aim to handle all complaints in a fair and efficient manner.
11.3 Consumer Advisory Services and Consumer Disputes Board (Finland)
If a dispute cannot be resolved through negotiation with us, a Consumer residing in Finland may contact:
- Consumer Advisory Services (Kuluttajaneuvonta), operated by the Finnish Competition and Consumer Authority (Kilpailu- ja kuluttajavirasto, KKV), for guidance and mediation; and
- thereafter, the Consumer Disputes Board (Kuluttajariitalautakunta) for a recommended decision.
More information is available at:
- Consumer Advisory Services / Kuluttajaneuvonta: www.kkv.fi/kuluttajaneuvonta
- Consumer Disputes Board / Kuluttajariitalautakunta: www.kuluttajariita.fi
11.4 Cross-border Consumer Disputes in the EU
If you are a Consumer residing in another EU member state and a dispute cannot be resolved directly with us, you may contact the European Consumer Centre in your country of residence for advice on cross-border consumer disputes.
In Finland, Consumer Advisory Services and the Consumer Disputes Board may provide assistance or recommendations in consumer disputes as described in section 11.3.
11.5 Courts
If a dispute is ultimately brought before a court:
- a Consumer may bring proceedings either in the district court of their domicile in Finland or in the Hämeenlinna District Court, or as otherwise provided by mandatory law; and
- Business Customers and the Service Provider shall bring any disputes before the Hämeenlinna District Court, Finland, as the court of first instance.
12. Products Reserved and Collected from Store via the Online Store (Click & Collect)
12.1 Nature of Click & Collect Orders
When you use a Click & Collect or similar service and reserve and/or pay for products via the Service for collection at our store, a distance contract is usually concluded in the same way as for home delivery orders.
Unless expressly stated otherwise during the order process, Click & Collect orders are treated as distance contracts and are subject to the same statutory right of withdrawal as other online orders.
12.2 Reservation Confirmation
When a product is reserved through the Click & Collect service, we will send you a confirmation stating the product, its availability and the pick-up location. This confirmation also serves as your order confirmation where the contract is concluded online.
12.3 Product Price
The product price applicable to Click & Collect reservations is the price displayed on the product page of the Service at the time of reservation. If the product price differs at the time of collection, the price valid at the time of reservation, as shown in the order or reservation confirmation, will apply.
12.4 Notification of Availability
We will notify you when the product is available for collection. We aim to do so within a reasonable time after the reservation has been made, while reserving the right to delays due to force majeure.
12.5 Collection Period
You are required to collect the reserved product within the period indicated in the confirmation, which is usually ten (10) days from the date of the reservation confirmation, unless otherwise stated. If the product is not collected within this period, we may cancel the reservation and return the product to sale.
12.6 Returns and Right of Withdrawal for Click & Collect
For Consumer Click & Collect orders that are distance contracts, the same 14-day right of withdrawal and return rules apply as set out in section 9. You may exercise your right of withdrawal by:
- returning the product to our store within the withdrawal period, or
- sending the product back to us by mail or carrier as described in our Return Instructions.
If the entire purchase is concluded only in-store without any binding distance contract, for example if the online interaction is merely a non-binding request and the actual sales contract is made and paid for solely at the store, the statutory distance selling right of withdrawal does not apply. In such a case, the store’s local exchange and return policy will apply. Where this is the case, it will be clearly indicated in connection with the reservation process.
12.7 Stock Discrepancies and Force Majeure
We are not liable for stock discrepancies caused by loss, theft or inventory errors that make it impossible to fulfil a Click & Collect reservation. In such cases, we will inform you without undue delay and refund any payments received. We are not liable for indirect damages resulting from such events, subject to your statutory consumer rights.
13. Force Majeure
13.1 Neither party shall be liable for delay or failure to perform its obligations, excluding payment obligations, if such delay or failure is due to an event beyond the party’s reasonable control (“force majeure”), such as:
- war, acts of terrorism or riot,
- natural disaster, fire or explosion,
- general labour dispute, strike or lockout,
- epidemic or pandemic,
- interruption or failure of public communications networks, transport services, severe disruptions in logistics or energy supply,
- customs actions, import restrictions, seizures, confiscations or other authority actions outside the party’s reasonable control, or
- legislative or governmental action, court order or prohibition by authorities.
13.2 The party invoking force majeure shall notify the other party of the event and its expected duration as soon as reasonably practicable.
13.3 If a force majeure event continues for more than thirty (30) days and substantially prevents the performance of the contract, either party may cancel the affected order by notifying the other party in writing.
13.4 Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law, including liability for intentional acts or gross negligence, or the Consumer’s mandatory statutory rights.
If you have any questions about these Terms or how they apply to your order, please contact our customer service at info@atom-airsoft.fi.
